The Supreme Court has slammed Noida for failing to provide the sanctioned plan of a builder’s project to home buyers. The apex court said that the authority is “reeking with corruption right from its eyes and nose”.

The observation by the bench comprising justice D Y Chandrachud and justice M R Shah came during the hearing of a plea by Supertech against the Allahabad High Court order directing demolition of twin 40-storey towers in Noida.

The apex court has reserved its order.

“This is a shocking exercise of power. You (Noida) are not only in the league but in cahoots with Supertech. When homebuyers asked for a sanctioned plan, you wrote to Supertech whether you should give the document or not and on denial you refused to give them the plan.

“It was only after the High Court expressly directed you to give that you had given them. You are reeking with corruption from eyes, nose and on the face of it,” as per a media report.

Allahabad HC judgment

Earlier in 2017, the Allahabad High Court had declared the construction of two towers illegal and ordered their demolition. The Supreme Court, however, put a stay order on it and directed Supertech to refund all the buyers who had invested in that property.

The twin towers were supposed to have 950 flats and the construction of 32 floors was already completed. The demolition order was passed on the plea put forth by the Residents’ Welfare Association (RWA) of Emerald Court Housing Society.

Close to 633 people had booked flats in those twin towers, out of which 248 have been refunded while 133 got new accommodation in other projects of Supertech. Around 252 buyers continue to remain optimistic amid all the happenings and hope for a favourable judgment from the SC.
