SC asks Amrapali homebuyers to clear dues

The Supreme Court on Friday warned the home buyers of Amrapali Group, that their flats would be cancelled and will be declared as unsold inventory if they don’t clear the dues as per the payment plan. Home buyers are under the impression that the court is facilitating the management of funds and construction of their stalled flats and are at a convenience to pay their dues, whenever they like, as observed by a special bench of Justice U U Lalit and Ajay Rastogi.

NBCC to hand over flats if they get Rs 200 crores

The remarks from the apex court came after senior advocate R Venkataramani, appointed as court receiver had noticed some mistakes in the list of 9,538 flats which are either unclaimed or booked on a fictitious name or are a benami property. The final list will be published in another two to three days, after making the corrections.

Representing home buyers advocate ML Lahoty said that officials of the NBCC would be in a position to handover around 2,000 to 2,500 flats situated in Amrapali Group’s stalled projects by December 2021, if Rs 200 crores are made available to them.

On this, the bench asked Lahoty, if the home buyers of  these 2,000 to 2,500 units would be able to clear their dues by October 15 as per the payment plan. The bench added that it can cancel the entitlement to the flats, if the home buyers fail to make payment of their dues.

The bench further asked Venkataramani the reason for delay in payment of dues by home buyers and suggested to issue notices to the persons who have not cleared the dues, if not their allotments would be cancelled.

To this, Venkataramani replied that most of the home buyers are paying their dues, as per the payment plan. However, those whose payment is through bank loans, which have been stuck for one problem or other.
